Definitions

For the purpose of these Terms and Conditions, “Clients” refers to any real estate agent, broker, or representative of a brokerage who has booked a service with FotoGema Photography. “Photographer” refers to any individual or entity representing FotoGema Photography who is engaged in capturing and processing photos for the Client.

Scheduling and Contact Information 

Clients should request photography appointments via text/email or through our online scheduler. We will confirm the date, time, and location of the shoot within 24 hours of the request. Once both parties have acknowledged the date and time of the appointment, the appointment will be considered “booked”. We primarily operate in the ORLANDO Area. For listings outside our service area, please text 321-900-9100 with the listing’s address for availability. Listings outside the Orlando Area require a bundle booking for stills, Matterport, and drone services.

At the Shoot 

The Client or an authorized representative must be present at the shoot to approve the Photographer’s interpretation of the project. If no representative is present, the Photographer’s interpretation will be deemed acceptable. The property must be staged and cleaned prior to the shoot, as properties will be shot “As Is”. Any post-production requests for item removal will incur additional charges. After the Shoot 

Images will be digitally retouched and delivered within 24-48 hours after the photoshoot unless otherwise specified. All images will be available in both WEB Resolution and MLS Resolution. Coming back to re-shoot is subject to an additional charge.

Cancellation and No-Show Policy 

Cancellations or rescheduling must occur at least 24 hours prior to the shoot. Any shoot canceled within 24 hours of a booked appointment is subject to a $25 Cancellation Fee. Cancellation within the hour or at the photoshoot incurs a $75 fee.

Rights and Usage 

The Photographer, or FotoGema Photography, retains copyright ownership of all images produced and only licenses the use of the images to the Listing Agent (“CLIENT”) of the property for marketing purposes while the listing is active (up to six months).  

The Client is granted a non-exclusive, non-transferable license to use the images for marketing the property and self-promotion. The license also extends to the Client’s parent company for the sole purpose of marketing the specific property photographed. All images produced for the client may be used by the client for any and all marketing materials and campaigns associated with the property and for the client’s self-promotion until the license expires.  

Any usage of the images by a third party, including but not limited to, architects, builders, stagers, designers, sellers, or buyers, is strictly prohibited unless approved in writing by the photographer.

Payments/Fees:

All sessions are booked and paid for beforehand on our website but before you are able to download the photos. FotoGema reserves the right to cancel, postpone, or refuse to schedule subsequent photo shoots until the account is made current.

Refunds:

All of our work meets our customers’ satisfaction. However, if for a valid reason you are not happy with the images we will return and retake them at no cost.
